GROUP OF BURGER RESTAURANTS IN YAKIMA, MONTANA AND OREGON CLOSED BY FRANCHISOR
After Wendy’s International files injunction against franchisee

January 31, 2012

(YAKIMA, WA) -- It is not often that a restaurant chain files a court injunction against one of its own franchisees to close down the franchisee’s restaurants for food safety and quality reasons.

But that is what happened in the case of some Wendy’s Restaurants in Washington, Oregon and Montana.

An injunction filed in a Montana federal district court against the franchisee BZB Enterprises on Jan. 20 alleges the franchisee had enough time to correct the company's concerns which included a refusal "to comply with Wendy's critical, non-negotiable food safety standards," according to a report in the Yakima Herald-Republic here

Two Wendy’s restaurants in Yakima, belonging to BZB, as well as Wendy’s restaurants in Havre and Whitefish, Montana and Pendleton, Oregon were closed last week after a judge agreed that BZB Enterprises failed to meet the operational standards of Wendy’s International.

Individual franchises were given time to cut their losses before closing, but BZB Enterprises continued to operate “without regard to Wendy’s food safety standards” and that put the company's name and goodwill at risk," according to the report.

The franchisee is reportedly in talks with the company to correct the issues and reopen the stores.
